Privacy Policy

We are committed to protecting your privacy. We will only use the information that we collect about you lawfully (in accordance with the Data Protection Act 1998). We collect information about you for 2 reasons: firstly, to process your order and second, to provide you with the best possible service.

We will not e-mail you in the future unless you have given us your consent. We will not pass your e-mail address to other trusted traders unless you agree. The type of information we will collect about you includes: your name, address, phone numbers, email addresses.

We will never collect sensitive information about you without your explicit consent.

We store information about you using cookies (files which are sent by us to your computer or other access device) which we can access when you visit our site in future. We do this to track the contents of your enquiry through the website and for marketing purposes.

If you want to delete any cookies that are already on your computer, please refer to the instructions for your file management software to locate the file or directory that stores cookies. Our cookies will have worktops.net in the file name.

Terms and Conditions of Contract

Definitions

  1. “Buyer” or “You” – person who buys or agrees to buy Products from the Seller.
  2. “Conditions” – terms and conditions of contract set out in this document and any special terms and conditions agreed between us in writing.
  3. “Delivery date” – date specified by the Seller when the Products are to be delivered.
  4. “Products” – goods specified.
  5. “Price” – total price for the Products including carriage, packing, installation and VAT.
  6. “Seller” – Lakestone Ltd Trading as worktops.net
  7. “Consumer” shall bear the meaning as described in section 12 of the Unfair Contract Terms Act 1977.

General

  1. Nothing in these conditions shall affect the Buyer’s statutory rights as a consumer.
  2. The Seller shall sell and the Buyer shall purchase the Products in accordance with any written quotation of the Seller which is accepted by the Buyer, or any written or verbal order of the Buyer which is accepted by the Seller including but not limited to orders placed using the Seller’s electronic online ordering service, subject in any case to these conditions, which shall govern the contract to the exclusion of any other terms and conditions subject to which any such quotation is accepted or purported to be accepted, or any such order is made or is purported to be made, by the Buyer.
  3. Any typographical or clerical or other error or omission in any sales literature, quotation, price list, acceptance of offer, invoice or other document or information issued by the Seller shall be subject to correction without any liability on the part of the Seller.
  4. If any provision of these conditions is adjudged invalid or unenforceable in whole or in part the validity of the other provisions of these conditions and the remainder of those provisions in question shall not be affected.
  5. Should the Seller not have available sufficient stock to deliver the goods ordered by the Buyer, the Seller will offer an alternative.  Should the cost change the Buyer will be expected to pay the increased or decreased costs. If the Buyer does not accept this as a reasonable option, then any sum paid minus any cost’s incurred will be refunded or credited to the Buyer’s account and the Seller will notify the Buyer at the address given by You in your order form. The refund will be made as soon as possible and, in any event, within 30 days of your cancellation and the Seller will not be obliged to offer any compensation for disappointment suffered.

Price and payment

  1. The price shall be that as stipulated in the Seller’s written quotation and not the that of the Estimate. Estimates are subject to point 4 of Price and payment. All prices provided by written Quotes are valid for 30 days and in the event of any increase in the cost to the Seller of raw materials, labour, overheads, or any increase in taxes or duties, or any variation in exchange rate the Seller may increase the price payable under the contract upon written notice. The Buyer shall have the right to cancel the order and receive back any sums they have paid minus any cost’s incurred.  Notice of cancellation must be received in writing by the Seller within seven days of delivery of the notice of price increase to the buyer.
  2. Payment for all orders is to be pro-forma basis with a 50% deposit and remaining 50% due 24 hours prior to installation. Please note these monies must have cleared our bank account, should your monies not clear our account in sufficient time we reserve the right to adjust your installation date to the next available slot. This may not necessarily be the next working day and could be up to 2 weeks later.
  3. If the contract is for sale of Products without services then payment of the Price shall be due at the date of the order. Time for payment shall be of the essence. If the Buyer does not pay the Price when notified that the Products are ready for delivery or installation the Seller may bring an action for the Price even though property in the Products has not been passed to the Buyer. If the Buyer fails to make payment as required the Seller may terminate the contract and suspend performance of any other until payment is made in full.
  4. Estimate and quote prices are subject to change based on the Seller’s discretion, for example but not limited to, sheet optimisation, joint positioning, warranties, other elements that may affect the quantities of materials required, address changes, labour requirements.  Not all elements of your design can be captured by the estimator such as waterfall legs, window cills, special edge details, which require further manufacturing time and thus further cost. The Seller will produce a full and up to date quote from the estimate completed by the Buyer. On receipt of templates or final drawings the Seller will finalise all prices to the Seller to consider any changes or increases in materials or other labours that may affect the cost which are above and beyond the original estimates.

Products

  1. The quantity and description of the Products shall be set out in the Seller’s quotation.
  2. The Seller may make any changes in the specification of the Products which do not materially affect their quality or performance required to conform with any applicable statutory requirements where the Products are supplied to the Seller’s specification.
  3. Photographs and samples supplied are for illustrative purpose only and may not exactly match the product itself.
  4. Worktop products are subject to natural variations in colour, porosity and texture. The Buyer accepts that such variations do not constitute grounds for rejection of the Products. Samples are available; however, samples of all products are subject to particle & colour variance and are only to be used as a guide not a control sample.

Delivery Only

  1. Delivery of the products shall be made by the Seller or his agent notifying the Buyer that the products are available for collection at the Sellers premises or for delivery to such place as the Buyer may specify at the time the order is placed.
  2. The Seller shall use his reasonable endeavours to meet any date agreed for delivery.
  3. In any event time of delivery shall not be of the essence however we aim to fulfil the delivery within 2-4 weeks from the date of the order. Please note some items may be delivered sooner or later than the above stated period.
  4. The Seller shall not be liable for any costs incurred for delay in delivery howsoever caused.
  5. All orders for delivery to addresses within mainland GB are delivered at the charge advised prior to order confirmation and any changes to address may result in additional costs payable by the buyer.
  6. For delivery to Northern Ireland, Isle of Man, Isle of Wight, Scottish Islands and Channel Islands we will only be able to deliver to a nominated mainland GB address e.g. a port at the advised charge. Onward shipping from that point and any export/import duties, documentation etc is the responsibility of the Buyer.
  7. Normal delivery times are 8am – 6pm Monday to Friday.
  8. Rejected deliveries howsoever caused may result in additional costs payable by the Buyer and if the delivery is returned, we reserve the right to charge a additional handling fee of £50 & further delivery charges will be incurred.
  9. Delivery is a 1 man drop, kerbside. Responsibility for (safe & successful) carriage of worktops to within the property lies with the customer, not with the Seller.

Please be advised that the Seller is delivering Products that require manual handling to be placed to your required destination. Your order mandates your presence during delivery and your assistance with unloading and proper positioning.

By proceeding with this delivery, you acknowledge and agree to the following terms and conditions:

  1. It is your responsibility to plan and assess the route and weight of the goods.
  2. Goods must be transported on edge, avoiding flat placement.
  3. Maintain a straight back and balanced posture when carrying goods. Ensure your feet are properly positioned.
  4. Never attempt to lift items beyond your capacity.
  5. Adequate protective footwear, preferably steel toe-capped, should be worn during handling.
  6. Exercise cautious and attentive handling at all times.
  7. When setting down the goods, do so gradually and carefully.

Please note that any damage resulting from dropping the Products is your responsibility.

You accept and fully understand that the handling of goods is entirely at your own risk, and any injuries incurred as a result of mishandling are your own responsibility.

By proceeding with a delivery, you acknowledge that you have read, comprehended, and accepted these terms and conditions pertaining to the handling and delivery of the Products.

Parking

Where specific parking areas or conditions apply, You/Buyer must provide a valid permit or similar & have sought any arrangements required to provide parking with shortest route to access and this is to be free of charge. You accept that any fines or additional parking costs will be payable by You.

Templating

Whereby the Seller has agreed to template on behalf of the Buyer, a site survey will be completed to assess access restrictions, safety and if the supporting framework is acceptable for use with the Seller’s products. The Seller takes no responsibility for any carpentry installed by others; the Buyer is solely responsible should any failures occur.

  1. You must make sure that the templater has access to the site at reasonable times (between 8am and 6pm on weekdays) or otherwise as agreed by the Buyer and the Seller. You will be provided with an arrival window time; this is not to be confused with your appointment times. You must allow up to 4 hours for the templater to complete his works.
  2. You must be present for the duration of the visit to answer any queries, and importantly must be prepared to approve and sign off the final templates and worktop specification at the end of the process.
  3. You must have agreed prior to the template visit, if templating is to be completed over existing worktops; had this not been agreed prior please see templating point 9.
  4. You must ensure existing worktops, sinks, taps and hobs are removed prior to the template visit except in the event of Templating point 3.
  5. You ensure any accessories, such as sinks, hobs, taps, extractors, sockets are on site and appliances including dishwasher, stoves & refrigerators are also to be in place whereby these may affect any dimensions required by templater. Should any of these items not be present, you must inform us by no later than 2 working days prior to the template appointment. Should you not comply to this please see Templating point 9.
  6. You must ensure all units are fitted, fixed and levelled in their final positions prior to the visit. You accept that you will not change, move or adjust units after the templating visit.
  7. The planned positions of Sinks, Taps, Hobs and other appliances (with their installation instructions) that are to be installed into the product must be finalised and agreed prior to the visit and this information available for the Templater.
  8. You agree that no alterations will occur post template, alterations may impact on the positioning of your Product.
    1. Level of carcasses will not be adjusted unless agreed by the templater, if this is severe the Seller withholds the right to enact Templating Point 9.
    2. Walls will not receive any further works, such as additional plaster.
    3. Tiling or Glass splashbacks should either be completed prior to the templating visit or after the installation visit.
    4. You acknowledge that by making any changes post template this may cause a cancelled installation and this may result in an additional charge to install at another time.
  1. The Seller reserves the right to abort a template at any time, should the templater believe these terms and conditions have not been met by You, a representative or your customer or other authorised representative. The Seller reserves the right to charge an additional visit fee.

Installation

  1. You must provide clear and unobstructed pathway from entry to the point of installation of the product.
  2. You must make sure that any re-routing or installation of plumbing (including water, radiators, drainage, gas, sewage and the like), or electrics have been carried out to a good workman-like standard prior to the fitting date;
  3. You must remove furniture and carpets as requested in the site survey. Seller will not be liable for damage to any furnishings that have not been moved as requested;
  4. You must provide a clear pathway to the room with sufficient working space for the fitter, and co-operate in reducing health and safety risks to an acceptable level;
  5. You must provide a guest parking permit if you live in a controlled parking zone or alternatively make necessary payment for time vehicle is parked.
  6. You have told us of any features which You know about the site or its construction which may make the installation more difficult than we might reasonably expect.
  7. You acknowledge that you have checked the walls are sound.
  8. No alterations to the level of carcasses and walls can take place between templating & installation of the Product; as such alterations may impact on the positioning of your worktop. This includes any tiling or plastering, which should be completed after the installation.
  9. We recommend final wall preparation (i.e., painting, wallpapering, etc.) should not be completed prior to installation if possible. Care will be exercised during the worktop installation; however, scrapes, punctures or digs to wall surfaces are possible in the work area. The Seller does not offer any repairs to these areas should they occur.
  10. We do not provide temporary work surfaces between Templating and Installation, therefore this must be arranged by others if a working kitchen is required during this time.
  11. Products must be signed off at the time of installation by the Buyer. Should the Buyer not be present at installation, You accept should you not be present it is assumed this is an acceptable installation and any issues that may have been rectified at the time of installation will incur further costs at the standard installation costs.
  12. The Seller reserves the right to abort an installation at any time, should the installer believe these terms and conditions have not been met by You, a representative or your customer or other authorised representative. The Seller reserves the right to charge an additional visit fee.

Sealant

Joints between worktops and upstands will have a adhesive applied.

Stone Site joints – will have a silicon applied. Any kitchens with different materials eg quartz and wood will have silicon applied to the joints.

Over time these sealants may need to be re-applied by the end user. The following items are common and will result in the sealant deteriorating.

  1. Aggressive Cleaning. Silicon can be dragged out
  2. Settlement in the kitchen floor. The cabinets drop and leave a gap in the sealant and or steps in the site joints.
  3. Expansion / Contraction. All materials move due to this which results in gaps appearing.
  4. Discolouration. Sealant attracts dust before it cures and will discolour in a dusty environment.
  5. Sealant Curing Time. Worktops must be left for 24 hours before being cleaned so that sealant can set/cure.

The Seller will not be held responsible for any sealant issues and do not offer a warranty for any application of sealant by installation teams.

Please note that the gaps between the top of the upstand and the wall are not considered in the Seller scope of works. These are due to walls not being straight and are usually filled with flexible caulk and painted by the end user.

However, this joint can have sealant applied if requested and is suitable.

Vein Matching

Whereby a colour has random veins, colour shades & particles as part of the aesthetics, please note, due to these random patterns it is unlikely to have a continuous flow of the pattern when 2 sheets or 2 pieces of the same sheet are seamed together.  The change of pattern will show up on the seam area. Vein Matching between worktops, upstands and end panels is at the discretion of the Seller. The Seller will take no responsibility for pattern and vein matching in any fabricated material.

Disclaimer Colour

Where a colour includes the mark *Disclaimer, please note this colour is prone to show dust, scratches and other wear and tear more easily.  We therefore recommend that this colour should not be used in applications where the surface is exposed to high traffic & contact area’s, e.g. kitchen worktops & commercial work surfaces.

Manufacture

  1. All manufacturing details/specifications will require approval by the buyer.
  2. The buyer is responsible for all final drawings and specifications taken at template stage and approved prior to manufacture.

Returns and Cancellations

  1. The Seller offers no return policy for bespoke fabricated worktops and so are non refundable. This applies for all bespoke/manufactured orders that have been started or completed. If cancelled the goods will be invoiced as per the order acknowledgement at full value.
  2. A minimum of 30% restocking charge will be applicable to any returns or cancellations on any Products. Bespoke materials or orders are non-refundable. Any cancellations after 14 days from order date will not be eligible for restocking and payment for 100% of materials will be required.
  3. Any cancellations received after 7 days of the date on the Contract are at the discretion of the Seller. Should any cancellation be accepted, deposits are non-refundable.
  4. Any cancellations must be made in writing and communicated by email to the Seller.

Warranty and Acceptance

  1. Stone Products are sold as seen. No warranty is provided in respect of any stone products except that the Buyer may, within 48 hours of delivery/installation and in accordance with Clause 5, return any products with which he is not satisfied. The Buyer shall be deemed to have accepted the Products 48 hours after delivery/installation.
  2. Product Warranty Claims are the responsibility of the Supplier and not the Seller. For example, a Corian product failure claim will be the responsibility of Du Pont not the Seller. The Seller will not take responsibility for any fabrication costs or any associated site costs eg plumbing, electrical, joinery, decoration etc or due to a third party Product Warranty claim.
  3. If you experience slight colour differences in areas such as joints, window cills, upstands or splashbacks on all materials, the Seller regards this as an acceptable result due to light diffraction when a change in the angle or grain of material is against an opposing piece and as such will not consider any claims to replace worktops due the slight variances it may cause to tone/colour/particles due to light particles, diffraction or shadows.
  4. Bespoke fabricated sinks, bowls, basins or troughs for kitchens, bathrooms and washrooms will be supplied with a 12 month period manufacture only warranty. This applies to all products. Any leakages, de-lamination or defects will not be covered past the 12 month period.
  5. By proceeding with the installation of the worktop, you acknowledge and agree that upon completion of the installation by any parties, the worktop is deemed satisfactory unless notified otherwise within a period of 48 hours from the installation date. Failure to report any faults or dissatisfaction within this timeframe implies acceptance of the workmanship and quality of the worktop. Any subsequent requests for alterations or refunds beyond this period may not be entertained.
  6. The Seller will take photographs of the product at delivery/installation, and these may be referred to in the event of any issues or claims raised.

Title and risk

  1. Risk of damage to or loss of the Products shall pass to the Buyer upon delivery.
  2. Notwithstanding any other provision herein title in the Products shall not pass to the Buyer until the Seller has received in cash or clear funds payment in full.
  3. The Seller reserves the right to ownership of the Products belonging to the Seller in the event of insolvency, failure of payment, debit or credit card fraud, debit or credit card claw back by the Buyer in dispute to any issues relating to the Products. The Seller reserves the right to collect the products having provided the Buyer with written notice allowing the Buyer 7 days to resolve any outstanding payments or claw backs.
  4. The Buyer shall not be entitled to pledge or in any way charge by way of security for any indebtedness any of the Products which remain the property of the Seller, but if the Buyer does so all moneys owing to the Seller shall (without prejudice to any other right or remedy on the Seller) immediately become due and payable.

Insolvency

  1. Seller shall be entitled to cancel the contract or suspend performance without further liability if:
    1. The Buyer makes any voluntary arrangements with its creditors or becomes subject to an administration order or (being an individual or firm) becomes bankrupt, or (being a company) goes into liquidation (otherwise than for the purposes of amalgamation or reconstruction) or
    2. An encumbrancer takes possession, or a receiver is appointed, of any of the property or assets of the Buyer, or
    3. The Buyer, not being a consumer, ceases, or threatens to cease, to carry on business, or
    4. The Seller reasonably apprehends that any of the events mentioned above is about to occur in relation to the Buyer and notifies the Buyer accordingly.
  2. If the Products have been delivered but not paid for the Price shall become immediately due and payable.

Indemnity

  1. Customer is solely responsible for and hereby agrees to keep Seller indemnified against all liability arising from:
  2. Buyer’s failure to obtain any necessary planning consent or to comply with other statutory regulations relating to the installation or use of the Products.
  3. Operation or use of the Products other than in strict accordance with the manufacturer’s operating instructions

Liability

  1. Seller’s liability to the Buyer for any default or breach whatsoever arising shall in no case exceed the contract Price.
  2. The contractual liability of the Seller is limited to the purchase value of the products. Under no circumstance shall the Seller be financially liable to the Buyer for loss of profit, income lost, costs of downtime or, in general, for losses of any kind that the Buyer may suffer due to non-delivery or faulty delivery of the products.
  3. The Buyer shall be solely liable, exempting the Seller where applicable, for damages stemming from the improper use, storage, preservation, processing or handling of products.
  4. For this purpose, the Seller has provided the Buyer with all the necessary documentation and instructions for the safe and proper use of products.
  5. Likewise, the Seller is exempt, with regard to third parties, of any legal, contractual or extra-contractual liability that may arise from the handling, treatment and installation of products made by companies other than the Seller.
  6. The Buyer is responsible for complying with the existing legal provisions on the environment, and especially for the managing waste produced in the handling and processing of acquired materials or their packaging.
  7. Therefore, the Seller shall have the right to modify the delivery times of the goods agreed with the corresponding Buyer and/or these General Conditions of Sale due to circumstances beyond its scope or control, including, among others, regulatory changes, natural or social or legal conditions (restrictive regulations on foreign trade operations, changing market conditions that may restrict or substantially affect the product supply or prices, as well as unforeseen tariffs or taxes) or force majeure that are beyond its control.

Force majeure

Neither party shall be liable for any delay or failure to perform any of its obligations if the delay or failure results from events or circumstances outside its reasonable control, including but not limited to, strikes, lock outs, accidents, war, fire, reduction in or unavailability of power at the Seller’s premises or its manufacturing plant, breakdown of plant or machinery or shortage or unavailability of raw materials from a natural source of supply, material breakages during manufacture and the party shall be entitled to a reasonable extension of its obligations.

Notices

Any notice required or permitted to be given by either party to the other under the conditions shall be in writing and in the case of notices to the Seller, addressed to the Seller at its registered office or in the case of notices to the Buyer, at the Buyers address as provided to the Seller by You.

Third party Rights

For the purposes of the Contracts (Rights of Third Parties) Act 1999 [and notwithstanding any other provision of this contract] this this contract is not intended to, and does not, give any person who is not a party to it any right to enforce any of its provisions.

Law

This Contract shall be governed by the law of England and Wales and any dispute question or remedy howsoever arising shall be determined exclusively by the Courts of England and Wales.

Warehouse Sale

Warehouse stock is “sold as seen” the buyer is responsible for assessing the condition of the item(s) prior to purchase. The seller is not liable for any defects, marks, scratches or other blemishes and the seller is not providing any representation about the quality or purpose of the goods. Sold as seen goods are accepted at point of signature and no disputes will be entertained once the goods are signed for. All warehouse stock is nonreturnable. Refusal of delivery will incur a restocking charge, and delivery fees are non-refundable.

Where applicable, these terms supersede all other terms and conditions.
